Understanding the Worker Protection Act 2023

What it is, what it means, and how to respond

What is the Worker Protection Act?

The Worker Protection (Amendment of Equality Act 2010) Act 2023 is a UK law aimed at strengthening protections against sexual harassment in the workplace.

The Act introduces a new legal duty requiring employers to take reasonable steps to prevent sexual harassment of their employees. It came into effect in October 2024.

This is a shift from the previous legal framework, where employers were primarily judged on how they responded after incidents occurred. Under the new law, there is a clear expectation of prevention

What Does This Mean for Employers?

The Act places greater responsibility on employers to foster safe, respectful workplace environments. Key implications include:

  • A new duty to take reasonable preventative steps against sexual harassment

  • Enforcement by the Equality and Human Rights Commission (EHRC)

  • Employment tribunals can apply a 25% uplift in compensation if the duty is breached

  • A requirement to show active efforts to reduce risk, not just respond after the fact

This duty applies across all sectors and to organisations of all sizes.
